Judge rules defendant in fatal 2017 crash must give his cell phone passcode to police

Judge Michael Mulcahy has ruled in favor of a Commonwealth motion to compel defendant Ryan Fellion to reveal his cell phone passcode to police investigating the Feb. 17, 2017 crash on Route 9 in Belchertown that claimed the life of Amherst resident Larry Kelley.

Fellion, 19, of Belchertown, faces a charge of motor vehicle homicide by negligent operation and related charges in connection with the fatal crash.

Police took custody of his cell phone but were unable to access the contents due to encryption requiring a passcode. Mulcahy ruled that the defendant must give his cell phone passcode to Massachusetts State Police investigators so that they can complete a search warrant on his cell phone.  Mulcahy denied a defense motion to suppress the seizure and search of the phone.

Fellion is due in Eastern Hampshire District Court, this Friday, Feb. 16,  at 8:30 a.m. for a pre-trial hearing.
